When you download, install, access or use "Hikememo" (hereinafter referred to as "this application" or "we"), you confirm that you have carefully read, fully understood and unconditionally agreed to accept all the terms of these Terms of Service" (hereinafter referred to as "this agreement"). If you do not agree with any of the contents of this agreement, please stop downloading, installing or using this application and related services in any way immediately.
Article 1: Subject and Scope of Application of the Agreement
1.1. This agreement is jointly concluded by you and Xingshanji (hereinafter referred to as "we") and has the effect of a legal contract.
1.2. Incorporated third-party terms: If you obtain this application through distribution channels including but not limited to the official website, Apple AppStore, Xiaomi App Store, Huawei App Store, Honor App Store, VIVO App Store, OPPO App Store, etc., you acknowledge and agree that your relationship with us is not only bound by this agreement, but also subject to Apple's Apple Media Terms of Service and Conditions and Licensed Application End User License Agreement (EULA). This agreement applies in parallel with the aforementioned Apple terms; if there is a conflict in matters such as application distribution, license scope and Apple's responsibility distribution, the relevant agreement of the EULA shall prevail. At the same time, it is bound by Xiaomi, Huawei, Honor, VIVO, OPPO and other relevant terms.
1.3. Service availability: Some functions provided by this application may be limited by your geographical region, device model or operating system version. The actual available functions and services are subject to the final presentation of this application in your device.
Article 2: Service Overview and Nature
2.1. This application is a personal management and reference tool designed for hiking enthusiasts. It provides functions including but not limited to equipment management, hiking plan formulation, track recording and navigation, data statistics and achievement system, outdoor security knowledge base, automatic renewal membership service, i cloud data backup and cross-device synchronization, and Apple Watch supporting applications.
2.2. Service nature statement: All information, data and functions provided by this application do not constitute any form of medical advice, professional rescue guidance and provision, accurate mapping or absolutely reliable navigation guarantee. All content is for reference only.
3.1. Capacity: You should have the full civil capacity required to conclude and perform this agreement. If you are a minor, you should use this application under the guidance and supervision of your legal guardian, and all relevant responsibilities shall be borne by your guardian.
3.2. Device-level license: This application does not have a separate user account registration and login system. Your usage rights are based on the license of your personal device, verified by your Apple ID and App Store subscription status, or bound by the unique identifier of the mobile phone.
3.3. User responsibility: You should be responsible for ensuring the security of the Apple ID or related account used for subscription and payment, and properly keep your device (including but not limited to setting up secure unlocking methods and updating the operating system in time). Any data loss or economic loss caused by device loss, jailbreak, system abnormality, malware infection or improper system permission setting shall be borne by you.
3.4. Data management: You can perform data cleaning or reset operations by uninstalling the application. If cloud synchronization is enabled, you need to go to the system "Settings > Apple ID > iCloud > Manage Account Storage" to manage or delete the data of this app. Android manages and deletes through Nut Cloud.
3.5. Restrictions on use: If we have reasonable grounds to believe that your use is illegal, infringing or poses a significant risk to the normal operation of this application and the rights and interests of other users or third parties (see Articles 8 and 9 for specific acts), we have the right to unilaterally complain to Apple or other app stores to restrict functions, stop providing updates or revoke device-level licenses.
Article 4: Fees, Subscription and Payment
4.1. Service mode: This application provides free basic functions and paid membership subscription services. The membership service is an automatic renewal mode, and the renewal cycle (monthly/quarterly/yearly) is subject to the display of the subscription page in the software.
4.2. Payment and deduction: All fees on the iOS side are charged by the Apple App Store. You authorize Apple to automatically deduct fees and extend the corresponding service period through your bound payment method within 24 hours before the end of each subscription cycle.
